Health is higher on the international agenda than ever before, and improving the health of poor people is a central issue in development. Poor people suffer from far higher levels of ill health, mortality, and malnutrition than do those better off, and their inadequate health is one of the factors keeping them poor or for their being poor in the first place. Health is a crucially important economic asset, particularly for poor people. Their livelihoods depend on it. Luke Demaitre's Leprosy in Premodern Medicine: A Malady of the Whole Body is a highly interesting study of the medical history of leprosy and the medical and social perceptions on leprosy that have been around for centuries. Remarkably, it is likely that leprosy will disappear from the face of the Earth in our generation, thanks to the development of a curative treatment and its increasing availability (although the battle has not yet been won completely). Demaitre's book is a very good (...) read not only for its information about leprosy but also for all interested in or affected by the social phenomenon of stigma. In illnesses such as leprosy, HIV/AIDS, epilepsy, and mental disorders such as schizophrenia, the stigma attached to the condition may be worse than the condition itself. (shrink)

Driven by interests in workforce planning and patient safety, a growing body of literature has begun to identify the reality and the prevalence of missed nursing care, also specified as care left undone, rationed care or unfinished care. Empirical studies and conceptual considerations have focused on structural issues such as staffing, as well as on outcome issues – missed care/unfinished care. Philosophical and ethical aspects of unfinished care are largely unexplored. Thus, while internationally studies highlight instances of covert rationing/missed care/care (...) left undone – suggesting that nurses, in certain contexts, are actively engaged in rationing care – in terms of the nursing and nursing ethics literature, there appears to be a dearth of explicit decision-making frameworks within which to consider rationing of nursing care. In reality, the assumption of policy makers and health service managers is that nurses will continue to provide full care – despite reducing staffing levels and increased patient turnover, dependency and complexity of care. Often, it would appear that rationing/missed care/nursing care left undone is a direct response to overwhelming demands on the nursing resource in specific contexts. A discussion of resource allocation and rationing in nursing therefore seems timely. The aim of this discussion paper is to consider the ethical dimension of issues of resource allocation and rationing as they relate to nursing care and the distribution of the nursing resource. Das Altern ist nicht nur eine biologische, sondern auch eine kulturelle Tatsache. Als Objekt der Verhandlungen zwischen Wissensdiskursen erscheint Alter als ein ebenso heterogenes wie problematisches Phanomen, das von Werturteilen und Weltanschauungen bestimmt wird. Des Weiteren sind Alter und Medizin in der offentlichen Meinung moderner Gesellschaften eng miteinander verbunden. Das interdisziplinare Forschungsprojekt "Kulturelle Variationen und Reprasentationen des Alters" geht von einem erweiterten, die geistes-, sozial- und medizinwissenschaftlichen Diskurse integrierenden Konzept von Alterskulturen und Potentialen des Alters aus. Dies bedeutet, Alter als (...) Gegenstand des Wissens und als Konzept zu begreifen. Alterskonzepte, das heisst Vorstellungen, Wertungen und, Bilder des Alters, sind Deutungsmuster fur elementare Bedurfnisse an der Schnittstelle von individuellem und kollektivem Leben. This article proposes a reflection on the persistence of Nazi jurisdictional models in contemporary legal theory, briefly comparing the work of authors such as Wolf, Larenz, Schmitt, Dworkin and Alexy. It aims to demonstrate the authoritarian and radically undemocratic character of certain theoretical constructions used in adjudication, particularly in Brazil. For this purpose, three representative judicial decisions from 2016 are analyzed, highlighting typical structural features of Nazi legal theory which remain accepted by current legal theory, such as the disregard (...) for legality, the personification of the community as judge and the appeal to social values which are taken as self-evident. Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

Frederick F. Schmitt offers a new account of Hume's epistemology in A Treatise of Human Nature, which alternately manifests scepticism, empiricism, and naturalism. Critics have emphasised one of these positions over the others, but Schmitt argues that they can be reconciled by tracing them to an underlying epistemology of knowledge and probability.

Human science researchers tend to be targeted for critique on the grounds that their approach is too individualistic to take due cognisance of societal and political influences. What is accordingly advocated is that the phenomenological and so-called romantic theories should be abandoned in favour of analytic or continental theories that have as their main focus the system, the group, the society, and the various influences of the social world on the existential reality of the individual.Without trying to invalidate these social (...) science strategies, this paper attempts to show that it is not necessary to surrender phenomenology in order to understand not only the individual, but also the social world in which individuals live. It is argued that the desired goal of a less individualistic human science’s theoretical basis can still be founded in phenomenology, in that Merleau-Ponty’s philosophy, which has its origin in Husserlian phenomenology, provides us with an adequate ontology for understanding human existence more comprehensively. Merleau-Ponty’s ontological philosophy elucidates the in-between world, that structure of existence where the individual cannot be separated from her/his world context. In his exploration of the reversibility of existence, Merleau-Ponty demonstrates that there is no ontological gulf between the individual and the social world. Instead, the world is ‘in’ the individual as much as the individual is ‘in’ the world. With this phenomenological epistemology, it is argued, it is possible to generate research that is capable “of more than a frozen existence”, as Merleau-Ponty puts it. (shrink)

This paper explores how managers’ and supervisors’ equity incentives impact the likelihood of committing corporate fraud in Chinese-listed firms. Previous research has shown that corporate fraud in China is a widespread phenomenon and has severe consequences for affected firms and executives. However, our understanding of the reasons that fraud is committed in a Chinese setting has been very limited thus far. This is an increasingly important topic, because corporate governance is rapidly changing in China, and it is unclear whether adopting (...) the executive compensation practices of the West is appropriate for Chinese firms. We show that managers’ equity incentives increase their propensity to commit corporate fraud. We also find that this effect is more pronounced for state-owned firms. However, we find a negative but not significant relationship between the equity incentives of the supervisory board and the incidence of fraud. (shrink)

The aim of this article is to analyse environmental reporting in the Australian broadsheet newspaper The Sydney Morning Herald. The focus is on a particular kind of new, multisemiotic news story genre that appears regularly in this newspaper, and that makes use of word-image play. Using a social semiotic framework and employing Appraisal theory, we analyse a corpus of 40 stories in terms of evaluative meanings in heading, image and caption, and interpret the significance of our findings in terms of (...) both Critical Discourse Analysis and Positive Discourse Analysis. In particular, we question whether the playing with environmental stories in the news, and the resulting clash between the humorousness of the play and the seriousness of the reported environmental event, is good or bad practice. With its multisemiotic focus, this article aims to make a significant and innovative contribution to the emerging field of ecolinguistics, and the development of Appraisal theory. (shrink)

As part of a multifactorial approach to address weak incentives for innovative antimicrobial drug development, market entry rewards are an emerging solution. Recently, the Duke-Margolis Center for Health Policy released the Priority Antimicrobial Value and Entry Award proposal, which combines a MER with payment reforms, transitioning from volume-based to “value-based” payments for antimicrobials. Here, the PAVE Award and similar MERs are reviewed, focusing on further refinement and avenues for implementation.

The principle of openness is central to human science approaches to research where the researcher becomes closely involved with the phenomenon under study. This article addresses both the practical and theoretical challenges that confront the researcher who seeks to be open. It also clarifies the meaning of the concept of openness and considers its relationship to the ideal of objectivity. Openness, it is argued, is neither an enduring state nor a trait but requires an ongoing struggle and has different forms (...) at various stages in the research process. Integral to this process is the experience of "being in the dark" which makes it especially difficult for the researcher to remain open. Various ways of managing this experience are presented. The study reported in this paper focused on nursing students' learning and, in particular, their integration of caring science in theory and practice. An educational model incorporating educational drama was developed for implementation in three different teaching contexts within the nursing and midwifery study programmes at a Swedish college. A central aim was to understand the dynamics of educational drama in the healthcare context and its impact on learning and teaching. Using a phenomenological approach, seventeen students and six teachers were (...) interviewed and their experience of drama as an educational method explored.The research findings illustrate the meaning of learning and teaching that is sensitive to students' lifeworld experiences. In order to be a successful method for closing the gap between caring science theory and practice, not only the educational drama, but teaching in general, must be anchored in the lived world of the students - that is, their experiences of health and care. While embodied reflection, as a key factor in integrating theory and practice, was shown to be well supported by educational drama, it was also found that "the method" tends too readily to take over and govern teaching and learning. The findings of this study further indicate how learning in practice and embodied reflection can be supported by the inclusion of well-chosen caring science theory to cast light on caring practice dilemmas. While political economic perspectives of urban globalization tend to generalize the economic pressures upon socio-political transformations of cities, recent European research has stressed the institutional context of urban collective action. However, the structural bias of the European city model merely complements the criticized economization by a culturalist essentialization of urbanity, and thus fails to conceptualize political agency. In order to elaborate the theoretical foundations of a political counterhypothesis to urban globalization, this article clarifies the different historical and normative conceptions of (...) institutional structure and agency in the urban context. Most research of cities implies — more or less implicitly — a common urban ideal which associates centrality with a local integration potential of plural societies. However, distinguishing between a historically embedded empirical category, a normative model of public space, and an analytical ideal-type of political agency helps to overcome the static structural conception of an essentially European urban culture and problematizes the role of knowledge models in reflectively constructing urban realities. Therefore, a dynamic and contextual relation between political economic functions, historic heritage, and normative frames might contribute to an open-ended comparative framework of urban collective action that can be applied to any ordinary city across and beyond Europe. Although a number of people, including scientific experts, welcome these developments, a considerable skepticism exists among members of the public. The use of genetically modified organisms is a case in point. In science policy and in science communication, it is widely assumed that such controversial science and technology require public participation in the policy-making process. We examine this view, which we call the (...) Public Participation Paradigm, using the case of GMOs as an example. We suggest that a prominent reason behind the call for public participation is the belief that such participation is required for democratic legitimacy. We then show that the most prominent accounts of democratic legitimacy do not, in fact, entail that public participation is required in cases of controversial science in general, or in the case of GMOs in particular. | : Beaucoup d’avancées scientifiques et de technologies émergentes sont controversées. Bien qu’un certain nombre de personnes, incluant des experts scientifiques, sont favorables à ces développements, la population demeure largement sceptique. Le recours aux organismes génétiquement modifiés illustre une telle situation. Dans les politiques et communications scientifiques, il est largement tenu pour acquis que de telles controverses scientifiques et technologiques requièrent la participation publique dans le processus de prise de décision politique. Nous examinons ce point de vue, que nous appelons le paradigme de la participation publique [Public Participation Paradigm], en nous servant du cas des OGM. Nous suggérons qu’une raison centrale en faveur de l’appel à la participation publique se situe dans la croyance qu’une telle participation est requise par la légitimité démocratique. Nous montrons ensuite que la plupart des principales conceptions de la légitimité démocratique n’impliquent pas, en fait, que la participation publique puisse être requise pour les controverses scientifiques en général, et pour les OGM en particulier. In this paper we offer an appreciation and critique of patient-led care as expressed in current policy and practice. We argue that current patient-led approaches hinder a focus on a deeper understanding of what patient-led care could be. Our critique focuses on how the consumerist/citizenship emphasis in current patient-led care obscures attention from a more fundamental challenge to conceptualise an alternative philosophically informed framework from where care can be led. We thus present an alternative interpretation of patient-led care that we (...) call ‘lifeworld-led care’, and argue that such lifeworld-led care is more than the general understanding of patient-led care. Although the philosophical roots of our alternative conceptualisation are not new, we believe that it is timely to re-consider some of the implications of these perspectives within current discourses of patient-centred policies and practice. The conceptualisation of lifeworld-led care that we develop includes an articulation of three dimensions: a philosophy of the person, a view of well-being and not just illness, and a philosophy of care that is consistent with this. We conclude that the existential view of well-being that we offer is pivotal to lifeworld-led care in that it provides a direction for care and practice that is intrinsically and positively health focused in its broadest and most substantial sense. A finalidade do texto seguinte consiste na exposição de uma relação de promiscuidade entre a técnica e a ciência na obra de Jean-François Lyotard. A primeira etapa deste artigo consiste na apresentação de um problema referente à obra A condição pós-moderna, onde a noção de técnica aparece sobre uma perspectiva positivista. Aqui, a intimidade entre técnica e ciência é resultado da crise dos fundamentos das ciências na modernidade, crise oriunda do afastamento entre as ciências e os discursos que se prestavam (...) frequentemente à sua legitimação. Esses discursos, que Lyotard aproxima do modelo narrativo, e dos quais se destacam o discurso político de emancipação e o discurso filosófico especulativo, entram em declínio na condição pós-moderna. As ciências, desprovidas de motivações ou destinos humanistas, não resistem à lógica capitalista, e encontram o intermediário de sua relação com o capital na técnica. O critério da ciência deixa, pouco a pouco, de ser a busca pela verdade e passa a ser a busca pelo melhor desempenho. A segunda e conclusiva etapa do artigo, consiste, por sua vez, na radicalização dessa promiscuidade, e se refere principalmente ao livro O inumano. A assim chamada tecnociência corresponde à completa submissão da ciência à técnica: se a visão positivista de A condição pós-moderna vê na técnica um suplemento, uma prótese que dá assistência à pesquisa científica, no segundo livro, a ciência se mostra a prótese ou o suplemento da técnica, que se revela, não obstante, inumana. Nessa segunda parte do artigo, pretendo mostrar que a visão positivista da técnica não é, portanto, suficiente para compreender a relação promíscua que ela tem com a ciência, mostrando-se necessário o recurso à perspectiva clássica da mesma: é a partir da visão da técnica como produtividade cega da physis que alcançamos também o entendimento do caráter inumano da tecnociência. Carl Schmitt veröffentlichte einen Großteil seiner wichtigen Werke im Verlag Duncker & Humblot. Im Zuge der engen Zusammenarbeit mit dem damaligen Verlagsleiter Ludwig Feuchtwanger entwickelte sich ein reger intellektueller, anspielungsreicher Austausch auf Augenhöhe zwischen Autor und Verleger. Ludwig Feuchtwanger, ein heute nahezu vergessener Intellektueller der jüdischen Renaissance nach dem Ersten Weltkrieg, vermochte es, auf Schmitts Interessen einzugehen und diese z.T. zu lenken. Dieser nun erstmals edierte Briefwechsel zeichnet ein Bild zweier Gelehrter in der Weimarer Republik, veranschaulicht u.a. auch die (...) materielle Lage eines wissenschaftlichen Autors und gibt Einblick in den damaligen Buchmarkt. Daneben finden sich Bausteine zur Biographie Carl Schmitts und Ludwig Feuchtwangers sowie ihren intellektuellen Netzwerken. Der Briefwechsel dokumentiert zugleich aber auch das Scheitern einer Freundschaft. (shrink)

Carl Schmitt unterhielt zeitlebens eine beeindruckend umfangreiche Korrespondenz. Seine Briefpartner waren höchst unterschiedlich. Es zählten dazu sowohl Künstler, wie Gelehrte aller Art, insbesondere juristische Kollegen als auch sonstige Persönlichkeiten.Ein Teil seiner Korrespondenz, nämlich die mit Ernst Jünger und mit Armin Mohler wurde in den letzten Jahren bei Klett-Cotta bzw. dem Akademie-Verlag veröffentlicht. In unserem Hause erschienen 1989 Briefe an Carl Schmitt, die der langjährige frühere Leipziger Studentenpfarrer Werner Becker in den Jahren 1923-1978 an Schmitt gerichtet hatte. Die (...) Schreiben Schmitts, die sich leider nicht mehr erhalten haben, erschließen sich insoweit, als Becker darin auf vorangehende Schreiben Schmitts inhaltlich eingeht. Im Dezember 2003 erschien in der Festschrift für Werner Krawietz unter dem Titel »Legalität, Legitimität und das Politische - Ein Briefwechsel« eine von Florian Simon aus unserem Verlagsarchiv zusammengestellte Korrespondenz Schmitts, die dieser in den Jahren 1931-1933 mit Ludwig Feuchtwanger, in den Jahren 1913-1936 wissenschaftlicher Leiter unseres Hauses, geführt hat.In Spanien war einer von Schmitts intensiven Briefpartnern, der 1915 geborene Römischrechtler Prof. Dr. Álvaro d'Ors. Er kannte Schmitt anfangs nur mittelbar und zwar über seinen Vater, den Philosophen und Essayisten Eugenio d'Ors. Dieser war mit Schmitt seit 1929 befreundet und hatte ihm in seiner Schrift Glosario mit der Darstellung seines Rangs und Originalität seiner Denkweise ein Denkmal gesetzt. 1944 lernten Álvaro d'Ors und Schmitt sich auch persönlich kennen, bei Gelegenheit eines Vortrags von Carl Schmitt »Vitoria und sein Ruhm«, den dieser an der Universität von Granada hielt. An diese war Álvaro d'Ors kurz zuvor zum Ordinarius für Römisches Recht berufen worden.Der Briefwechsel zwischen Schmitt und d'Ors setzt 1948 ein und endet 1983, zwei Jahre vor dem Ableben Schmitts. Der Briefwechsel war begleitet von einer Reihe von Begegnungen in Deutschland, aber mehr noch in Spanien, und zwar insbesondere in Santiago, wohin d'Ors später berufen worden war. Dort lebte seit 1959 auch Schmitts einzige Tochter Anima, nach Ihrer Eheschließung mit Alfonso Otero, Ordinarius für Rechtsgeschichte an der dortigen Universität.Der hier nun vorgelegte Briefwechsel zeigt, wie sehr die theoretischen und praktischen Interessen beider Juristen miteinander verwoben, aber dennoch ihre Denkansätze und Ergebnisse sehr verschieden waren. Der Briefwechsel führt uns durch einen für beide Partner überaus fruchtbaren Dialog zu grundlegenden Aspekten des Denkens beider Autoren: der Nomos der Erde, die Einheit der Welt, Ausnahme und Norm, Legalität und Legitimität und politische Theologie.In sorgfältigen und umfangreichen Anmerkungen der Herausgeberin werden dem Leser Zusammenhänge und Hintergründe erschlossen sowie die in den Briefen erwähnten Persönlichkeiten vorgestellt, die dem deutschen Leser weitestgehend unbekannt sind. Die Briefe mit den Anmerkungen geben einen aufschlußreichen Einblick in das Denken der Briefpartner und insbesondere Carl Schmitts. Sie sind zugleich ein spannendes Zeitdokument und ein Beitrag zur Geistesgeschichte Deutschlands und Spaniens. (shrink)

Protein–protein interactions are thought to be mediated by domains, which are autonomous folding units of proteins. Recently, a second type of interaction has been suggested, mediated by short segments termed linear motifs, which are related to recognition elements of intrinsically disordered regions. Here, we propose a third kind of protein–protein recognition mechanism, mediated by disordered regions longer than 20–30 residues. Bioinformatics predictions and well‐characterized examples, such as the kinase‐inhibitory domain of Cdk inhibitors and the Wiskott–Aldrich syndrome protein (WASP)‐homology domain 2 (...) of actin‐binding proteins, show that these disordered regions conform to the definition of domains rather than motifs, i.e., they represent functional, evolutionary, and structural units. Their functions are distinct from those of short motifs and ordered domains, and establish a third kind of interaction principle. With these points, we argue that these long disordered regions should be recognized as a distinct class of biologically functional protein domains. (shrink)
